How can a personal injury solicitor help you with your case?
A personal injury solicitor plays a vital role in representing people who have suffered an injury as a result of someone else’s negligence, to make a claim.
By law, a personal injury claim in Ireland must begin with the PIAB (the Personal Injuries Assessment Board).
The personal injury solicitor will handle all aspects of the case on your behalf, such as pursuing settlement offers, dealing with the defendant, and attending court hearings if necessary.
This relieves the stress associated with dealing with written correspondence from the defendant or attending Court on your own, should the case require you to do so.
Personal injury solicitors are also likely to know more about the law and how courts work than an individual without a legal background, which means they can better represent your injury case. This can significantly improve the likelihood of a successful claim.
Gibson & Associates LLP personal injury solicitors are specialists at representing people with an injury to make a claim, and have an in-depth understanding of the law and how it applies to individual cases. Our team also understands that sometimes these cases can be particularly emotional, and will approach your case with the utmost sensitivity to ensure you feel fully supported throughout the process.

Our personal injury solicitors specialise in the following areas of personal injury:
Road Traffic Accidents
Whether you were involved in a road accident and hurt as a driver or a passenger in a car, on a bus or coach, as a pedestrian or cyclist, or were involved in a road traffic accident at work, our personal injury solicitors can provide specialist advice for your situation.
Accident at Work Claims
A workplace accident can happen to anyone, but it shouldn’t mean that you have to suffer financially because of it.
A workplace accident claim supports you to achieve fair financial compensation for any injuries or other losses.
Accident in Public Places
The most common accidents in public places are caused by slipping or tripping over an object or by falling because the object is defective or broken.
An example is falling over a broken step or kerb in a public place.
A medical negligence claim for financial compensation may be made when a patient suffers an injury or illness as a result of a mistake made by their doctor or hospital (or both).
A birth injury is when something goes wrong with a mother or baby during or after childbirth.
A birth injury doesn’t have to just occur during labor and the delivery. It can cover pregnancy, which impacts wrongful birth, and the post-birth period.
A catastrophic injury is generally defined as any serious injury that results in permanent disability, long-term medical problems or reduced life expectancy.
Catastrophic injuries can cause extreme pain and suffering. Financial compensation can help cover the costs of required care.
Frequently asked questions
What is a Personal Injury Claim?
When someone is injured as a result of someone else’s negligence, the injured person might be entitled to make a personal injury claim against the person or organisation who caused the injury, to recover financial compensation for the negative or personal impact of the injury.
Personal injuries can be physical injuries, mental injuries, and property damage.
How to make a Personal Injury Claim
If you would like to make a personal injury claim for compensation, you can submit your application online or send your personal injury application and documentation by post.
You will need to include:
• A completed Application Form (Form A) (pdf) which can be submitted online or by post.
• A Medical Assessment Form (Form B) (pdf) completed by your treating doctor. This can be submitted online or by post.

How long does a a Personal Injury Claim take in Ireland?
Before you can file a personal injury claim, you must submit your case to the PIAB (the Personal Injuries Assessment Board). The respondent (the party responsible for the injury) has 90 days to agree to the process, and then the Board will assess your claim. Currently, it takes seven months for PIAB to assess cases and make a recommendation for compensation. At most, the process will take nine months.
What is the role of 'PIAB'?
The PIAB (Personal Injury Assessment Board) is an independent body that provides an assessment of personal injury claims for compensation following road traffic, workplace or public liability accidents.
You can read more about Making a Claim and Responding to a Claim on PIAB’s website.
What is the Statute of Limitations?
If you have suffered an injury, it is important to know you have a limited time to make a claim. These time limits are referred to as the Statute of Limitations and set out in the Statute of Limitations Act 1957. In most instances, you need to make your claim within two years of the incident.
What does 'No Win, No Fee' mean?
The concept of “no win, no fee” (also known as “no foal, no fee”) is common practice among solicitors in Ireland. Under this type of agreement, the solicitor will take on your personal injury or any other type of case, and if the case isn’t won, the solicitor won’t charge you a fee. The sole purpose of “no win, no fee” is to give you the legal power to pursue a claim regardless of your financial state or legal experience.
What type of Personal Injuries can I claim for?
The most common types of personal injury cases are vehicle accidents, medical malpractice, slip and fall cases, work place accidents, dog bites, product liabilities, and nursing home malpractice/abuse. For example, if someone was injured in a motor vehicle accident that was someone else’s fault, this could result in a personal injury case.
